BOW website is copyrighted and proprietary. Access is limited to authorized users only.
The Terms and Conditions and Privacy Policy constitute the "Agreement" between the Service Receiver/Payer and BOW. BOW and the Service Receiver/Payer are referred to as "Parties."
This Agreement governs the use of BOW Payment Gateway services and online payments. BOW reserves the right to modify these Terms without prior notice. Continued use constitutes acceptance of the revised Terms. If you disagree, you must stop using the services.
This Agreement is an electronic record under the IT Act, 2000, and does not require a physical or digital signature. It is governed by Indian laws and RBI guidelines.
Scope of Service
BOW uses a secure Internet Payment Gateway to process online payments as per RBI guidelines.
Key Terms
- Chargeback: Approved reversal of transactions due to duplicate processing, fraud, or disputes.
- Customer: A person making payments online for services received or agreed upon.
- Payment Instrument: Valid cards, wallets, or other methods issued by authorized providers.
- Facility Providers: Services facilitating transactions.
- Refunds: Subject to the Initial Service Contract and mutual agreement.
Fair Use of Payment Gateway
The gateway is exclusively for processing payments for services provided by BOW.
Chargeback & Refund Policy
Payments made for services are non-refundable unless agreed in the Initial Service Contract.
Warranty & Liability
BOW is not liable for any damages arising from service use.
Termination
- Immediate termination if services violate laws.
- Termination due to payment disruption by Facility Providers.
Force Majeure
BOW is not liable for failures due to uncontrollable events like system breaches, natural disasters, or strikes.
Jurisdiction & Arbitration
- Indian laws govern this Agreement.
- Disputes will be settled by arbitration under the Arbitration and Conciliation Act, 1996.
- Arbitration will take place in Mumbai, with English as the language.
- Courts in Indore have exclusive jurisdiction over legal matters.
